Please ensure that you have read and agree to the terms and conditions detailed below:
OVERVIEW
These terms and conditions set out the contract between you, the client, and Sugar & Spice Bakery (Isle of Man). They should be read prior to paying the deposit for your cake, at which point you enter into a contract, according to the details in the written order confirmation and these terms and conditions. Please ensure you check through the order confirmation carefully to ensure you are happy before paying your deposit.
PAYMENT CONDITIONS
PRICES
All cakes are priced according to your design as requested and the size of your cake, and are non-negotiable. Following your enquiry, your quote is valid for 14 days, after which point the cost may alter in line with suppliers' costs. Paying your deposit will secure this price & the slot in the diary. Any alterations to your initial enquiry may affect the price quoted.
DEPOSITS
For celebration cakes, a 50% booking deposit (total of the cake/delivery price if applicable) will be required when you place your order, in order to secure the booking. For weddings, a £50 booking fee is to be paid initially, with the remaining balance being paid one calendar month prior to your wedding date.
Bookings are not secure until the deposit is paid and we cannot hold spaces open in the case of non-payment of deposits. The deposit becomes non-refundable two weeks (14 days) prior to your booking date for celebration cakes, and two calendar months before your wedding date for wedding cakes.
PAYMENT
You will receive details of how to make payment when you place your order; please confirm once a payment has been made.
Final payment for your celebration cake can be made on the day of collection (Same day bank transfer prior to collection or cash). If you wish to pay by cheque, please allow 5 working days for clearance prior to collection date. Card payments are accepted. We require wedding cakes to be paid for in full one calendar month prior to your wedding date. You will be sent a reminder for payment prior to this date.
Cakes remain the property of Sugar & Spice Bakery until full payment has been made.
CANCELLATION/POSTPONEMENTS
CELEBRATION CAKES
If cancellation of a celebration cake order takes place more than 14 days before your event, you will be offered a refund of the deposit paid. If cancellation of the order is 14 days or less before the event, we reserve the right to retain your non-refundable 50% deposit.
WEDDING CAKES
For wedding cakes, your booking fee is refundable until two calendar months before your wedding. You will be charged the following for any cancellations after this point:
-Two calendar months to one calendar month prior to your wedding date - your £50 booking fee plus 50% of the total cost of your wedding cake quote.
- Less than one calendar month - your £50 booking fee plus the total cost of your wedding cake quote.
If you postpone your event, please advise us as soon as possible and we will try to accommodate your new date, however if this isn’t feasible, your order will be considered as a cancellation. If your wedding has to be postponed for any reason, we will do our best to accommodate your new date and your prior booking conditions will still stand. Any further changes to your event date will incur a new booking fee of £50.
We retain the right to cancel your booking in very unusual circumstances beyond our control, such as fire, flooding or ill health, during which we will refund any monies taken in full.
DESIGN CONDITIONS
We pride ourselves on creating original designs at Sugar & Spice Bakery and will not copy exactly the designs of others, so please do not ask us to. We will take inspiration from any photos you provide, but will make subtle changes so as to make it a unique, bespoke product, made just for you. We enjoy coming up with our own designs and will endeavour to put into a drawing whatever designs/ideas you may have. You will be provided with drawings of designs, where appropriate, but we cannot guarantee that our cakes will match designs exactly due to the nature of the cake making process and feasibility when creating your cake. As cake making is a creative process, we may decide to make subtle changes from the design provided to ensure your cake fits the brief.
ALTERATIONS & CHANGES
It is your responsibility to read & check the quote thoroughly; any amendments to design should be made prior to the deposit being paid. Any changes made after this point may incur additional costs.
If requested, once the deposit is paid, we will endeavour to adjust the design where possible, but sometimes this is not possible according to the nature of the request or amount of notice given. If the alteration affects the cost, or preparation work for the original design has already been undertaken, then your balance will be adjusted accordingly.
We reserve the right to make changes to the design at any point, if circumstances beyond our control may compromise the quality of the finished cake, e.g. melting due to weather. We will endeavour to advise you in good time should any changes need to be made.
Each cake is made individually by hand, so although every effort is made to ensure consistency, it may vary slightly from the design requested/picture supplied, as previously stated.
FRESH CREAM/CREAM CHEESE
Fresh Cream and Cream Cheese cakes must be refrigerated, hence we will not advise covering with sugarpaste. There are strict guidelines which must be followed when ordering a fresh cream or cream cheese cake. You will be advised at the time of collection how much longer the cake can remain safely outside of refrigeration. If being placed back in refrigeration, your cake will need storing at a temperature of 5 degrees celcius or less. We will not be held responsible for any issues relating to the cake not having been stored as instructed.
FLOWERS
If your cake requires fresh flowers, then these are not included in the price. We can work with your florist but expect you to make all the necessary arrangements with the florist. Any flowers which are to be used on the cake should be suitable for being on or next to edible items (non-toxic/organic/non-irritant) and will need to be placed in flower picks or dipped in safety seal to prevent contamination to the cake. We cannot take responsibility for any damage rendered to the cake caused by a floral arrangement that was implemented by anyone other than Sugar & Spice Bakery employees. We will also take no responsibility for anything that arises as a result of your cake being adorned with fresh flowers.
ALLERGIES & SPECIAL DIETARY REQUIREMENTS
It is your responsibility to advise us of any dietary requirements for your cake when the booking is made - cakes can contain a huge array of ingredients. You will be advised upon collection/delivery if any of the 14 known allergens are present in your cake, and also if there may be traces of these allergens. Cakes can be made free from gluten/wheat/dairy/soya/egg, but we cannot absolutely guarantee no traces of contaminants will be present in your cakes due to these, and other allergens, being present and used within the premises. We apologise, but we are unable to cater for nut allergies. Special diet cakes will be baked, stored and decorated separately to minimise cross-contamination issues.
NON-EDIBLE ITEMS
Most cakes contain small proportions of inedible items; it is your responsibility to ensure these are removed by your caterer/guests before consumption e.g. support dowels in tiered cakes, ribbon, wires in sugar flowers, flower picks & flower tape, cocktail or kebab sticks in models. You will be advised upon collection/delivery of any non-edible items.
DELIVERY CONDITIONS
Delivery charges are calculated on a mileage and time basis. Alternatively, cakes can be collected from our premises free of charge.
If you choose delivery, it is our intention that your cake will be delivered in perfect condition prior to the start of your event. However we ask for patience with factors that may be beyond our control (e.g. traffic conditions) as we cannot be held liable for any such delays. It is your responsibility to ensure you inform us of your correct ceremony and event time plus the postcode of the venue. In the unlikely event of late delivery, the maximum compensation will be a refund of the delivery price.
We cannot be held liable for any damage that is rendered to the cake at the venue once we have left the premises. It is with this in mind that we require somebody responsible to check that they are happy with the cake before we leave, whether this be a member of your party or a member of staff at the venue. As such, we will ask for a waiver to be signed confirming this.
If you choose to collect the cake, we will not be held liable for any damage to the cake once it has left our premises. You will be advised of the safest way to transport the cake in your vehicle.
Late requests for delivery (after securing the booking based on collection) will be accommodated where possible, but cannot be guaranteed, as prior confirmed delivery commitments must take priority.
CAKE SETUP
It is the client’s responsibility to ensure arrangements are made for the cake table/linen/cake stand, which should all be set up prior to our arrival. If any delay is incurred due to these not being set up, we reserve the right to charge for any delay incurred. Alternatively please pre-arrange for the cake to be left with the event manager to assemble/move into position as appropriate. A waiver will need signing to confirm that the cake has arrived without damage and assembly instructions will be provided. Please take extra care to ensure a stable cake table is available if you are having a marquee wedding, as surrounding floorboards can easily destabilise the cake once subject to footfall.
STORAGE & CONSUMPTION
PORTION GUIDE
You will be advised of how many portions your cake will slice into, dependant on your requirements. Please ensure your cake is cut as advised to ensure you have the correct number of portions.
BEST BEFORE DATE / STORAGE CONDITIONS
Your cake is baked to ensure it is fresh for the date of your event and is best consumed on the day of collection/delivery, and should be eaten with 3 days of this date. Cakes are made entirely of natural ingredients and will not have an extended shelf life.
Please store your cake in a cool, dry place and once cut, cover any exposed cake with cling film or similar. If your cake is covered with sugarpaste, it will 'sweat' if stored in an airtight box, but it will not affect the taste of your cake.
Refrigerating your cake will dry out the sponge and is not advised, particularly for sugarpaste covered cakes. Fresh cream/cream cheese cakes need refrigerating in an environment of 5 degrees celcius or less. Sugar & Spice Bakery will not be held responsible for any issues arising from refrigerators displaying incorrect temperatures.
DAMAGE
Please remember that cakes and cake decorations are very delicate items, and we cannot accept responsibility for damage that is done to the cake after it has been handed over to the client. Photographs will be taken of the cake prior to it leaving the Bakery for collection, and once set up after delivery.
In the event of damage to the cake, you can advise us and request a repair, which will be costed accordingly, including transport costs if appropriate. We will endeavour to do our best to fix any repairs, but cannot guarantee your cake being as it was prior to any damage.
COMPLAINTS
In the rare event of you having any concerns about your cake, please let us know immediately upon collection/delivery so that we can rectify it in time for your event. All other concerns should be made in writing, and evidence of the fault should be included. We would appreciate you contacting us in the first instance to give us the opportunity to rectify any issues arising. If you are unhappy with your cake for any reason, you will be asked to return the remainder of the cake/tier in order for us to assess the issue and any refunds offered are at the discretion of Sugar & Spice Bakery. A credit note may be offered under certain circumstances. No refunds are offered due to change of mind.
As referred to in the delivery conditions, in the event of a late delivery, the maximum compensation will be a refund of the delivery price; please be patient with factors that may be beyond our control (e.g. traffic conditions), as we cannot be held liable for any such delays.
